1. Definitions
1st 4 Coaches Ltd Terms and Conditions
In these Terms & Conditions the following words and phrases will have the following meanings:
“Agreement” Any agreement between 1st 4 Coaches Ltd and the hirer for the purchase of
Services as set out in section 3. (Agreement).
“1st 4 Coaches Ltd” Means 1st 4 Coaches Ltd , the details for which are given at the bottom of
these Terms and Conditions.
“Supplier” Means any third party provider contracted to to provide the Services on behalf of the
client.
“Hirer” The person solely responsible for the agreement that contracts services from 1st 4
Coaches Ltd as set out in section 3. (Hirer).
2. Application.
These terms and conditions shall apply immediately upon 1st 4 Coaches Ltd accepting a booking
in line with section 3. (Agreement).
3. Agreement
An agreement is formed when 1st 4 Coaches Ltd accepts a booking either verbally or in writing.
Any attempted changes to these Terms and Conditions either in writing or verbally by the hirer will
be disregarded. Only variations and amendments made in writing by 1st 4 Coaches Ltd will be
considered to take precedence over these Terms and Conditions.
The customer shall notify 1st 4 Coaches Ltd immediately of any concerns they may have in
respect of these Terms and Conditions.
4. Hirer
The hirer is the person who makes the booking and subsequently enters into an agreement with
1st 4 Coaches Ltd . The hirer will be responsible for all acts and/or omissions of the passengers
permitted to travel by the hirer and will therefore be solely responsible for any additional cost
incurred irrespective of whether the hirer actually travels.
5. Quotations & Bookings
Quotations given are subject to vehicle availability at the time of enquiry. The quotations given are
based on the information provided by the hirer, should there be any changes to the itinerary once
the hirer makes a booking the hirer accepts that the price will reflect these changes.
Quotations are based on the most direct route. The actual route used will be at the discretion of
the driver. Should the hirer wish to use a specified route this must be confirmed in writing by 1st 4
Coaches Ltd prior to travel, the hirer accept that 1) a specified route may change the cost of travel
and 2) due to size limitations and road restrictions specified routes may not always be possible.
Quotations given are inclusive only of vehicle, driver and fuel. Prices unless otherwise specified
do not include parking, tolls or any other additional costs.
Bookings are only confirmed by 1st 4 Coaches Ltd once an invoice/booking confirmation has
been sent to the hirer.
6. Seating & Loading the Vehicle
The hirer agrees to ensure that they have booked the correct size vehicle to accommodate all
passengers. The hirer must not load the vehicle beyond this capacity. Children and babies must
have an allocated seat to themselves.
7. Luggage
The hirer accepts that luggage carried are subject to restrictions for statutory safety reasons. The
hirer accepts that the driver shall be the sole judge as to whether and to what meet these
restrictions. Large items may not be able to be carried and the hirer should take all steps to notify
1st 4 Coaches Ltd in advance of such requirements.
Although 1st 4 Coaches Ltd will endeavour to take all reasonable steps to prevent loss or
damage, luggage and personal belongings are the sole responsibility of the hirer and passengers
at all times.
Should you leave or lose any of your luggage whilst travelling and it is recovered it will be handed
into the subsequent suppliers lost property. Please contact 1st 4 Coaches Ltd as soon as you are
aware of any lost items, we will then facilitate a time for you to collect or arrange a courier
collection at your own cost.
8. Amendments
All amendments must be made in a timely fashion prior to travel and in writing, 1st 4 Coaches Ltd
reserves the right to charge £25.00 administration fee for each amendment made along with any
increase in hire charges as a result of the route, time or vehicle size amendments.
9. Timings
The hirer agrees that they will depart at the times specified on the invoice/booking confirmation. It
is the responsibility of the hirer to ensure all passengers adhere to these timings. The hirer
acknowledges that any additional charges incurred by delays caused by the hirer or passengers
will be the sole responsibility of the hirer.
Please note that waiting time costs are dependant on vehicle size and supplier used. Should you
wish to know in advance the cost of waiting times please request these prior to travel.
Where the driver or coach are unable to wait for the hirer or passengers due to driving hour
regulations or other commitments the coach will be relieved of any obligation to provide the
service and shall have no liability to the hirer or passenger for any costs incurred by not
completing their journey. The cost of hire will also be charged in full and no refunds will be given.
10. Vehicle Use
The use of vehicle is permitted only for the itinerary which will be laid out in writing on the booking
/confirmation. The hirer cannot assume use of the vehicle between any transfers unless this has
been expressed in writing by 1st 4 Coaches Ltd.
11. Driving Hours
Driving hours are regulate by law. The hirer agrees to ensure that the hirer and passengers shall
not delay or otherwise interrupt the journey in such a way that the driver is at risk of breaching
regulations relating to driving hours and duty time. If a breach is likely to occur the hirer will be
responsible for any additional cost incurred including mandatory rest periods.
Drivers are only allowed to drive for 4.5 hours before they must take a 45 minute rest period. The
hirer accepts that they will account for this within their itinerary and adjust their timings as
necessary. 1st 4 Coaches Ltd does not accept any liability for any losses due to delays caused by
any legally required rest breaks.
12. Transportation of Animals
No animals are permitted on any vehicles with the exception of service dogs which must be
notified to the company in advance.
13. Payment & Cancellation
Full cleared payment in Pounds Sterling is due 30 days prior to the date of travel or immediately in
such instances that the travel is less then 30 days away, The exact dates will be set out in the
hirers invoice.
Where the booking is greater than 30 days away a deposit will be required with the full balance
due 30 days prior to travel. The hirer agrees to pay 1st 4 Coaches Ltd by the dates set out on the
hirers invoice.
Should the hirer fail to pay in a timely manner their booking may be at risk. 1st 4 Coaches Ltd
reserves the right to cancel any bookings where either the full payment or balance is overdue.
Should 1st 4 Coaches Ltd cancel your booking due to late payment we reserve the right to charge
the same as if the hirer cancelled the agreement themselves as per the below scale of charges.
Additionally 1st 4 Coaches Ltd reserves the right to charge interest on any late payments in line
with The Late Payment of Commercial Debts (Interest) Act 1998 at 8% per annum above the Bank
of England base rate together with compensation at the rate of £40-£100.00 per invoice.
1st 4 Coaches Ltd at its sole discretion may engage the services of a debt collection agency to
recover any unpaid amount together with interest and debt collection charges.
Cancellation by the hirer must be made in writing and the hirer agrees to the following scale of
charges:
Cancellation Notice Charge
30 Days or more 25% of total invoice cost.
15 – 29 Days 50% of total invoice cost.
8 – 14 Days 75% of total invoice cost.
1 – 7 Days 100% of total invoice cost.
The cost of accommodation, meals, event tickets and ferry crossings which have already been
purchased at the request of the hirer will not be refunded and will be charged in full
Cancellation due to inclement weather conditions will still be charged as above.
14. Additional Charges & Surcharges
Unless agreed otherwise in writing the price of hire will not include parking, tolls, tickets,
admission charges, ferries or crossings.
At your request we may book the above services on your behalf. No such services will be booked
without full payment in advance. The hirer agrees that any terms and conditions of the supplier for
such services sought will be adhered to as if the hirer had contracted such services directly.
Details of supplier terms and conditions can be sent upon request.
15. Vehicle to be provided
1st 4 Coaches Ltd reserves the right to at any time to substitute the vehicle booked with another
vehicle or multiple vehicles as long as it meets the minimum seating capacity.
16. Operator Cancellations
In the event that an operator cancels its contract with 1st 4 Coaches Ltd after the hirer has been
invoiced except for instances in section 11. (Payment & Cancellation) with regards to overdue
payments then an alternative coach of similar size and quality will be sourced from another
supplier.
1st 4 Coaches Ltd will use reasonable endeavours to keep any cost increases to a minimum
however reserve the right to pass on any additional costs levied by the new supplier to the hirer. In
the event that no other vehicles are available or the hirer does not wish to continue the agreement
with a new supplier 1st 4 Coaches Ltd will refund the full cost of the invoice. 1st 4 Coaches Ltd
will not be held liable for any consequential costs due to a supplier failing to honour the
agreement.
17. Force Majeure
1st 4 Coaches Ltd is happy to advise the hirer of approximate journey times however these time
are given in good faith and 1st 4 Coaches Ltd can not be held responsible for any late arrivals due
to the following.
1st 4 Coaches will not be deemed in breach of the agreement or liable to the customer for failure
or delay in fulfilling its obligations under the agreement due to force majeure. This includes: traffic
congestion, vehicle breakdown, emergency situations, acts of terrorism, accident, adverse
weather conditions, strikes or industrial defaulting of sub contractors.
18. Passenger Conduct
The driver is responsible for the safety of the vehicle at all times and as such has the right to
remove any passengers whose behaviour is in breach of the Public Service Vehicle (Conduct of
drivers, Inspectors, Conductors and Passengers) Regulations 1990.
The hirer is responsible for any damage caused to the vehicle by any passengers.
No bill or poster is to be displayed on the vehicle without prior written consent.
No consumption of food or alcohol will be consumed on the vehicle without prior written consent.
All vehicles are non smoking, any passenger found in breach of this will be removed from the
vehicle.
The hirer and all passengers shall maintain a high standard of behaviour at all times and ensure
any instructions given by the driver are adhered to.
The hirer and all passengers agree that they will not in anyway endanger themselves or the driver
by breaching safety instructions or statuary regulations relating to driving hours.
The hirer agrees that on arriving at their final destination they will remove any rubbish from the
vehicle.
The hirer is responsible for conduct of all passenger and therefore agrees to pay any cleaning cost
that does not purport to normal usage of the vehicle. Rubbish, spillages and sickness all require
additional cleaning and will be charged at the varying rate of each individual supplier. An hourly
cleaning charge can be requested prior to travel but usually start at £75.00 minimum.
Alcohol is not permitted under any circumstance when travelling to a sporting event. Please see
Sporting Events (Control of Alcohol) Act 1995 for further information.
19. Insurance
Although suppliers have the necessary public liability insurance to cover passengers these have
limitations and therefore 1st 4 Coaches Ltd recommends that the hirer and all passengers obtains
their own travel insurance.
20. Complaints & Compensation
The customer must notify 1st 4 Coaches Ltd in writing within 7 days of the termination of hire
with any complaints they have.
Should compensation be requested by the hirer they will be put in touch directly with the supplier
unless the mistake lies directly with a fault of 1st 4 Coaches Ltd services.
1st 4 Coaches Ltd will not be held liable for the failings of the service of a supplier and will
therefore not be responsible for direct or indirect consequential loss including but not Ltd to: loss
of profits, loss of business, depletion of goodwill or otherwise.
The hirer has several opportunities to check the itinerary that is booked. 1st 4 Coaches Ltd
provides a portal where customers can log in and check the details at any time inclusive of
whether payment has been allocated. It is therefore the responsibility of the hirer to check the
itinerary and ensure that all information is correct. Any errors must be highlighted immediately to
1st 4 Coaches Ltd in writing. 1st 4 Coaches Ltd will not be liable for any mis instruction to the
supplier due to failure of the hirer not checking their itinerary.
The hirer is responsible for providing any permits, documentation, special instructions to 1st 4
Coaches Ltd prior to the transport taking place. Any complaints for interruptions, delays and
failure of service resulting from this information not being provided at all or in a timely manner will
be deemed null and void.
The hirer is not permitted to set off, deduct or withhold funds of any outstanding balances in
relation to a complaint for services rendered.
